1. INTRODUCTION

This Dispute Resolution Policy ("Policy") governs how disputes arising from the use of the Karipe platform ("Platform") are handled. By using the Platform, you agree to resolve disputes through binding arbitration and waive your right to lawsuits or court proceedings, except where Karipe exercises its right to legal action for financial recovery.

This Policy applies to all users, including homeowners and contractors, and is an integral part of our Terms of Use, Contractor Agreement, and Escrow Payment Terms.

2. MANDATORY ARBITRATION AGREEMENT
  • All disputes must first be resolved informally by contacting Karipe at support@karipe.com.
  • If the dispute is not resolved within 30 days, it must be submitted to binding arbitration.
  • Arbitration will be conducted under the rules of the American Arbitration Association (AAA) in Wyoming.
  • Arbitration is the exclusive method of dispute resolution, and users waive the right to sue Karipe in court, except where Karipe seeks financial recovery.
3. ARBITRATION PROCEDURE
  • The arbitration will be conducted remotely unless both parties agree otherwise.
  • Each party is responsible for its own legal fees, except where the arbitrator determines bad faith actions.
  • The arbitrator’s decision is final and binding.
  • Users agree to waive class-action lawsuits and jury trials.
4. PROHIBITED OFF-PLATFORM TRANSACTIONS

To maintain the integrity of the Karipe Platform and ensure a secure transaction environment, all communications and financial transactions between homeowners and contractors must be conducted through Karipe. Users are strictly prohibited from engaging in off-platform payments, deals, or contract agreements. Any attempt to bypass Karipe’s escrow system to avoid fees or facilitate unauthorized transactions is considered a violation of these Terms.

🔹 Consequences for Off-Platform Transactions:
  • Temporary suspension or permanent ban from the Platform.
  • Legal action to recover damages, lost fees, and other financial losses incurred by Karipe.
  • Forfeiture of any pending escrow funds in cases of breach of contract.
5. EXCEPTION: KARIPE’S RIGHT TO LEGAL ACTION

Karipe reserves the right to pursue legal action in court if:

  • A contractor’s or homeowner’s actions result in financial loss to Karipe.
  • Karipe must recover unpaid fees, escrow funds, or damages.
  • A user engages in fraud, willful misconduct, or illegal activity on the Platform.

In such cases, Karipe may initiate legal proceedings in a court of competent jurisdiction in Wyoming.

6. GOVERNING LAW

This Policy is governed by the laws of Wyoming, without regard to conflict of law principles.

7. MODIFICATIONS TO THIS POLICY

Karipe reserves the right to modify this Dispute Resolution Policy at any time. Users will be notified of significant changes, and continued use of the Platform constitutes acceptance of the revised terms.
